If you are in business, IRS will try and get full payment if possible from any and all legal sources. An Offer-in-Compromise for a going business is almost impossible under current IRS policy.

If the Trust Fund is not paid, each individual that the RO believes is a "responsible person" under the Internal Revenue Code will get a letter proposing the penalty and they will be given 30-60 days to respond. Those individuals must file a timely protest or the penalty will be assessed. Because of the negative impact of a Federal Tax Lien, it is very important to protest the TFRP in a timely manner if you believe that you can asset a solid defense. If you are a secretary and did not have the independent authority to pay bills but did so only upon the direct order of the President or Controller, you may have a good defense. Each case is judged on the individual merits. Get a CPA, Enrolled Agent or Attorney with tax representation experience to help you sooner, rather than later. Do not hire some outfit you see on TV or be "sold" by a clever salesman. Insist on speaking with a licensed professional before you hire a firm to help you.

If you are charged with the TFRP and you know the assessment is valid, work with the IRS to get it paid. Do not delay or put your head in the sand. Look at securing loans or other means to pay IRS. Give the IRS all of the financial information they require when they ask for it in consultation with your tax professional. IRS considers payroll tax collection a top priority. More than ever before in recent memory, the possibility of criminal prosecution for payroll tax avoidance is possible. It is very rare, but the threat is real. Take payroll taxes very seriously.

Select the "MS-DOS (FAT)" option if you wish to make the drive compatible with Windows operating systems and give it a volume name. The format will begin when you click the "Erase" button below.

Formatting is a rather easy task so next time you feel the need of freeing up disk space or removing a nasty virus, you can format the device without nagging your techie friends and relatives in doing it for you. Just keep in mind that it is close to impossible to recover the data that you erased while formatting unless you have decent recovery tools so always double check your drive before you begin formatting.

Seven Steps to Create a Factory Default Recovery Disc

It used to be that when you bought a new computer, the computer manufacturer (Dell, Toshiba, Gateway, HP, etc.) would include a couple of discs which contained a backup of the original factory default operating system. These recovery CD's allowed you to reinstall the OS to exactly as it was when you first bought the computer.

In recent years these recovery CD's are no longer being included with the new computer (cheaper for the manufacturer - they don't have to create the discs). The default recovery data is now on the actual hard drive itself, and you the owner must copy (burn) this backup information to two or three DVD's.

The other day a client had just bought a new Gateway computer and asked me to make a backup of the original factory installation in case he ever needed to reinstall the OS, drivers and application files. In this article I would like to show you the exact seven steps that I used for this important one-time process (I did this on a Windows 7 Gateway desktop but most manufacturers provide basically the same setup procedure):

1) From the Windows default Start menu, click All Programs, Gateway and then click Gateway Recovery Management.

2) In the Gateway Recovery Management window, click Create factory default disc.

3) In the Make Backup Image dialog box, insert a blank disc in the optical drive, and then click Next.

4) Disc 1 is burnt and verified.

5) In the Finished dialog box, insert the next blank disc in the optical drive, and then click Next.

6) Disc 2 is burnt and verified.

7) In the Success dialog box, click OK.
